Registration Required:

Buyer must submit a warranty registration for each Dual-Cool product within 30 days after purchase either; 

(a) by mail at this Dual-cool web site. (Link to form - name, address, email phone, item(s) purchased, date of purchase.

(b) by e-mail at info@dual-cool.com 

(c) by snail mail to Dual-Cool, 7264 Cataluna Circle, Delray Beach, Florida 22446, U.S.A.  Registration is necessary for warrant coverage. Failure to submit a completed warranty registration will invalidate this Limited Warranty. 

 

WARRANTY

The manufacturer, of the Dual-Cool product line, Balance Industries (Balance) extends a limited warranty (this “Warranty") that the Dual-Cool branded product (The “Product”) is free of defects in materials and workmanship for a period of one (1) year from the date of retail purchase by the original Consumer of the Product (the “Original Consumer”).

 

WHO IS COVERED

This Warranty extends to only to the Original Consumer. Subsequent owners or users of the Product are not covered under this Warranty.

 

SOLE REMEDIES

Balance will provide the following remedies in the sequence provided to whatever extent it shall deem necessary to satisfy a proper claim under this “Warranty.

 

First, provide the necessary replacement parts free of charge for the Original Consumer to complete the repair and restore the Product to its proper operating condition. An example would be replacing a failed fan, the fan will be replaced free of charge with a new fan along with the correct Allen wrench to replace the damaged fan in minutes.

 

Second, if the repair cannot be accomplished Balance will:

1. Replace th Product with a direct replacement with a similar product of equal or greater value deemed by Balance to perform substantially the same function as the original Product, or

2. Refund the original purchase price of the Product. Note: The Original Consumer must be able to present the original receipt of purchase or other satisfactory proof of purchase.

 

REPAIR, REPLACEMENT, OR REFUND OF THE PURCHASE PRICE ARE THE EXCLUSIVE REMEDIES OF THE PURCHASER AND THE SOLE LIABILITY OF BALANCE UNDER THIS WARRANTY. 

 

WHAT IS NOT COVERED:

This Warranty does not cover product or equipment damaged due to misuse, abuse, or accident, including but in no way limited to (a) deterioration from wear or exposure, (b) improper maintenance, (c) failure to follow operating instructions, (d) cosmetic changes that do not affect performance, (e) improper installation, (f) improper or unauthorized repair or modification, or (g) “acts of God” or other contingencies beyond the control of Balance.

 

LIMITATION OF LIABILITY

Balance shall not be liable or assume responsibility for loss of time, loss or damage to personal property, expenses, or ant other incidental or consequential damages incurred as a result of or in connection with the use or ownership of the Product.

 

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you special legal rights, and you may also have other rights which vary from state to state.
